§ 1
[Wahlscheine und Legitimationen]

[Letters of credence and Members' passes]
§ 1. (1) Jedem Abgeord- neten wird nach seiner Wahl oder nach seiner Berufung als Ersatzmann von der Bundeswahl- behörde ein Wahlschein ausgestellt, der in der Parlamentsdirektion zu hinterlegen ist.
§ 1. (1) The Federal Election Board shall issue to each Member of the National Council after his/her election, or after his/her appointment as a substitute member, a Letter of Credence which shall be deposited with the Parlia- mentary Administration.
(2) Die Parlamentsdirektion stellt jedem Abgeordneten, für den der Wahlschein hinterlegt ist, eine amtliche Legitimation mit seinem Lichtbild aus.
(2) The Parliamentary Administration shall issue an official pass bearing his/her photograph to each Member whose letter of credence has been deposited.

§ 2. (1) Ein Abgeordneter wird seines Mandates verlustig:

1. wenn er die Angelobung nicht in der im § 4 vorge- schriebenen Weise oder überhaupt nicht leistet oder sie unter Beschränkungen
oder Vorbehalten leisten will;
1. if s/he fails to take the official oath, or fails to take the oath in the form required in § 4 below, or makes reservations or imposes conditions
under which s/he is willing to take the oath;
2. wenn er durch 30 Tage den Eintritt in den Nationalrat verzögert hat oder 30 Tage ohne einen vom Nationalrat anerkannten triftigen Grund (§ 11 Abs. 4) von den Sitzungen des Nationalrates ausgeblieben ist und der nach Ablauf der 30 Tage an ihn öffentlich und im Nationalrat gerich- teten Aufforderung des Präsidenten, binnen weiterer 30 Tage zu er-
scheinen oder seine Abwesenheit zu
2. if s/he delays taking his/her seat for 30 days or remains absent from the sittings of the National Council for 30 days without valid reason (§ 11 (4)) recognised as such by the National Council and has failed to obey the President's order addressed to him/her publicly and before the National Council to appear or justify his/her absence within a further period of 30 days;

(2) Wird einer der im Abs. 1 Z 1 bis 3 vorgesehenen Fälle dem Präsidenten zur Kenntnis gebracht, so hat er dies dem Nationalrat bekannt zu geben, der mit einfacher Mehrheit über den im Art. 141 Abs. 1 B-VG vorgesehenen Antrag be- schließt. Dieser Beschluss ist durch den Haupt- ausschuss vorzubereiten.
(2) The President shall, when notified of one of the cases defined in (1) 1.-3.
above, so inform the National Council, which shall decide by a simple majority on a motion provided for in Article 141 (1) of the Federal Constitutional Law (B-VG), which decision shall be prepared by the Main Committee.
(3) Wird ein Beschluss nach Abs. 2 vom Nationalrat gefasst, so hat dessen Präsident den Antrag namens des Vertretungs- körpers beim Verfassungs- gerichtshof einzubringen.
(3) If the National Council takes a decision under (2) above, the President shall make an application to the Federal Constitutional Court on behalf of the National Council.

(5) Nach Einlangen eines
Erkenntnisses des Verfassungsgerichtshofes
beim Präsidenten des Nationalrates, mit dem der Verlust eines Mandates ausgesprochen wird, hat der Präsident jene Person, die durch das Erkenntnis des Verfassungsgerichts- hofes ihres Mandates für verlustig erklärt worden ist, hievon zu verständigen. Der Verlust des Mandates tritt ein mit dem auf die Zustellung des diesen Ausspruch enthaltenden Erkenntnisses des Ver- fassungsgerichtshofes an den Präsidenten des Nationalrates folgenden Tag. Der Präsident hat in der nächsten Sitzung des Nationalrates das Er- kenntnis bekannt zu geben.
(5) After receipt of the decision of the Constitutional Court by which the member in question is declared to have lost his/her seat, the President of the National Council shall so inform the person so deprived of his/her seat. The loss of seat shall enter into force on the day following the receipt by the President of the National Council of the
decision of the Constitutional Court by which the seat is declared lost. The President shall inform Members of the court decision at the next sitting of the National Council.
(6) Abs. 5 gilt sinngemäß auch für den Fall, dass der Verfassungsgerichtshof
einer Wahlanfechtung stattgegeben hat, weil eine nicht wählbare Person für gewählt erklärt oder einer wählbaren Person die Wählbarkeit zu Unrecht aberkannt worden ist.
(6) The provisions of (5) shall apply mutatis mutandis to cases in which the Constitutional Court has granted an application contesting an election result on grounds of an ineligible person having been declared elected or an eligible person having been
unlawfully declared
ineligible.
(7) Im Falle des Art. 141 Abs. 2 B-VG verlieren die betroffenen Abgeordneten ihr Mandat erst mit dem Zeitpunkt der Hinterlegung der Wahlscheine der bei der Wiederholungswahl ge- wählten Abgeordneten in der Parlamentsdirektion.
(7) In cases under Art. 141 (2) B-VG the Members concerned shall only lose their seats at the time the letters of credence of the Members elected in the repeated election are deposited with the Parliamentary
Administration.
(8) Verzichtet ein Abge- ordneter auf die weitere
Ausübung seines Mandates, so wird dieser
Verzicht mit dem Einlangen der Mitteilung der Bundes- wahlbehörde hierüber beim Präsidenten des National- rates rechtswirksam, sofern in der Verzichtserklärung nicht ein späterer Zeitpunkt angeführt ist.
(8) If a Member resigns his/her seat, said resignation shall take effect at the time of receipt by the President of the National Council of the Federal Election Board's notification to that effect, unless the resigning member has stipulated a later effective date.

§ 4. (1) Über Aufforderung des Vorsitzenden haben die Abgeordneten bei Namens- aufruf durch die Worte „Ich gelobe“ unverbrüchliche Treue der Republik, stete und volle Beobachtung der Verfassungsgesetze und aller anderen Gesetze und gewissenhafte Erfüllung ihrer Pflichten zu geloben.

(1) The chairperson shall make a roll-call of Members, who shall take their oath of office by pronouncing the words "Ich gelobe" ("I promise"), swearing to faithfully uphold the Republic, to faithfully respect the Constitutional Laws and all other enactments at all times, and to perform his/her duties conscientiously.

§ 6. (1) Die Präsidenten und der Hauptausschuss, an Stelle des letzteren im Falle der Auflösung des National- rates gemäß Art. 29 Abs. 1 B-VG der Ständige Unterausschuss des Haupt- ausschusses, bleiben im Amte, bis der neugewählte Nationalrat die Präsidenten und den Hauptausschuss neu gewählt hat.

Die Ergebnisse der Konstituierung eines Klubs sowie Veränderungen derselben sind dem Präsidenten unverzüglich schriftlich mitzuteilen.
§ 7. Members who belong to the same political party that participated in the election may form a Parliamentary Group. The minimum number of members required for recognition shall be five.
Members who do not belong to the same political party can form a Parliamentary Group only with the approval of the National Council. The President shall without delay be informed of the formation of a Parliamentary Group or changes in its membership.

(2) The President's Conference shall act as a deliberative organ. Its duties shall above all include the presentation of proposals for the execution of programmes of work, the determination of the agendas and times of National Council sittings, the referral of items of business to the committees, the coordination of committee meetings and for the cultivation of international parliamentary relations.

§ 9. Jeder Abgeordnete, dessen Wahlschein in der Parlamentsdirektion hinter- legt ist, hat für die Dauer der jeweiligen Gesetz- gebungsperiode so lange Sitz und Stimme im Nationalrat, als nicht seine Mitgliedschaft aus einem der im § 2 genannten Gründe erloschen ist.
§ 9. Every Member whose letter of credence has been deposited with the Parliamentary Adminis- tration shall have a seat and a vote in the National Council for the duration of its term as long as his/her membership does not expire for one of the reasons listed in § 2 above.

Die Behörde hat jedoch eine Entscheidung des Nationalrates über das Vorliegen eines solchen Zusammenhanges einzu- holen, wenn dies der betreffende Abgeordnete oder ein Drittel der Mitglieder des mit diesen Angelegenheiten betrauten ständigen Ausschusses verlangt. Im Falle eines solchen Verlangens hat jede behördliche Ver- folgungshandlung sofort zu unterbleiben oder ist eine
solche abzubrechen.
(3) Otherwise, Members shall, without approval of the National Council, only be prosecuted for punishable offences which are obviously in no way connected with their political activities. However, the prosecuting authority shall, upon demand of the Member concerned or of one third of the members of the Standing Committee having jurisdiction over such matters, seek a decision of the National Council on whether or not any such connection exists.
Once such a demand has been made, the prosecuting authority shall immediately cease to take action or stop any action already undertaken. If the National Council determines that there is a connection between the alleged offence

and the Member's political activity, it shall at the same time decide on whether or not it approves the prosecution of the Member in question.
(4) Die Zustimmung des Nationalrates gilt in allen diesen Fällen als erteilt, wenn der Nationalrat über ein entsprechendes Er- suchen der zur Verfolgung berufenen Behörde nicht innerhalb von acht Wochen entschieden hat.
(4) The National Council shall in all such cases be deemed to have given its approval if it fails to decide within eight weeks on a request for a decision made by the competent prosecuting authority.
(5) Im Falle der Ergreifung auf frischer Tat bei Verübung eines Ver- brechens hat die Behörde dem Präsidenten des Nationalrates sogleich die geschehene Verhaftung bekannt zu geben. Wenn es der Nationalrat oder in der tagungsfreien Zeit der mit diesen Angelegenheiten betraute Ständige Aus- schuss verlangt, muss die Haft aufgehoben oder die Verfolgung überhaupt unterlassen werden.
(5) If a Member is apprehended flagrante delicto in the performance of a felony, the authority in question shall without delay notify the President of the National Council of the arrest of the Member. On demand of the National Council or, between parliamentary sessions, of the Standing Committee having jurisdiction over such matters, the authority shall release the arrested Member or altogether refrain from prosecuting him/her.
(6) Die Immunität der Abgeordneten endigt mit dem Tag des Zusammen- trittes des neugewählten Nationalrates, bei Organen des Nationalrates, deren Funktion über diesen Zeitpunkt hinausgeht, mit dem Erlöschen dieser Funktion.

§ 11. (1) Jeder Abgeordnete ist verpflichtet, an den Sitzungen des Nationalrates und der Ausschüsse, in die er gewählt ist, teilzu- nehmen.
§ 11. (1) It shall be incumbent upon every Member to attend the sittings of the National Council and of the committees to which s/he has been appointed.
(2) Ist ein Abgeordneter verhindert, an einer oder mehreren aufeinander folgenden Sitzungen des Nationalrates teilzunehmen, so hat er oder der Klub, dem er angehört, dies der Parlamentsdirektion vor Beginn der Sitzung be- ziehungsweise der ersten von mehreren aufeinander
folgenden Sitzungen mitzuteilen.
(2) If a Member is unable to attend one or several successive sittings of the National Council, s/he or the Parliamentary Group to which s/he belongs shall inform the Parliamentary Administration of his/her absence prior to the beginning of the sitting or the first of several successive sittings.
